Introduction

Protecting the privacy of our users is important to us. Plink, Inc., also operating as Plink® (“Plink,  “we,” “us” or “Company”) has developed this Privacy Policy to describe how we may collect, retain, process, share and transfer your Personal Information when you visit our Site or use our Services. This Privacy Policy applies to your Personal Information as you use our Site and our Services and does not apply to online websites or services that we do not own or control.

This Privacy Policy is designed to help you obtain information about our privacy practices and to help you understand your privacy choices when you use our Sites and Services.

Definitions

“Campaign” shall mean advertising, promotional or marketing campaigns featuring a variety of programs which enables allows Participants to Link registered Payment Cards via the Collinson Platform in order to have rewards and offers credited to their Participant Account.

“Collinson” means Collinson CLO, Inc. or such other data aggregator that we may contract with to provide to us certain data matching transactions between the Merchant and Participants.

“Collinson Platform” shall mean Collinson’s technology and platform (including software, servers, and associated user interface) by which Collinson matches Participant’s registered Payment Card transactions with Merchants and transmits Transaction Data.

“Collinson Services” shall mean the Transaction Matching services and transmission of Transaction Data to the Company to be performed by Collinson to us as enabled by the Collinson Platform.

“FancoinTM means a virtual denomination that represents Participant’s Personal Savings issued by or on behalf of Merchant to Participant to reward Participant for engaging in Merchant prescribed behavior.

“Fanstore” means a virtual store populated with Merchant’s and, where applicable, certain third-party rewards (goods, services and experiences) which can be redeemed by Participant using Fancoins.

“Financial Institutions” shall mean those financial services institutions that have arrangements with Collinson Group to facilitate the validation of Redemptions, including, without limitation, payment network partners (such as American Express, MasterCard and VISA).

“Link” (and variations thereof) shall mean the act of connecting a Participant Transaction with a Payment Card registered with Collinson Group so as to allow tracking and validation of Redemptions and transmission of Transaction Matching information.

“Participant(s)” shall mean a user, consumer, or customer of a Merchant who has registered for the Program and uses his or her Payment Card for the purposes of earning Personal Savings.

“Merchant” shall mean a merchant business participating in the Program.

“Participant Account” shall mean a Participant’s Program account in which Participant’s Personal Savings are credited.

“Participant Data” shall mean Participant data collected from the promotion of Personal Savings Programs and related Campaigns from a Party’s respective websites and platforms.

“Payment Card” shall mean any eligible registered payment card, debit card or credit card issued by Financial Institutions and supported by the Collinson Services. Most credit and debit cards with a logo from MasterCard®, Visa® or American Express® are eligible for participation. Refer to the Program Terms of Service for further details on eligibility of cards.

“Program” shall mean variety of activities deployed by the Company on behalf of participating Merchants designed to leverage social media, promotions, automated communications, data, Savings, electronic gift cards, Store Credits and incentives to increase consumer awareness of participating Merchants and to motivate consumers to purchase goods and services at participating Merchants.

“Personal Information” means personal information that can be associated with an identified or identifiable person. “Personal Information” can include name, postal address (including billing and shipping addresses), telephone number, email address, payment card number, other financial account information, account number, date of birth, and government-issued credentials (e.g., driver’s license number, national ID, passport, Social Security number and Taxpayer ID).

“Personal Savings” or “Savings” shall mean Fancoins, goods, services, experiences, discounts, gift cards and such other incentives as the Company may offer Participants from time to time for such Participant’s participation in the Program. Savings carry no Cash Value until the time of Redemption.

“Process” means any method or way that we handle Personal Data or sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, and consultation, disclosure by transmission, disseminating or otherwise making available, alignment or combination, restriction, erasure or destruction of Personal Data.

“Program” shall mean variety of activities deployed by the Company on behalf of participating Merchants designed to leverage social media, promotions, automated communications, data, Savings, and incentives to increase consumer awareness of participating Merchants and motivate consumers, and to purchase goods and services at participating Merchants.

“Qualified Transaction” shall mean all transactions made by Participants using their eligible Payment Card at participating Merchants.

“Redemption” (and variations thereof) shall mean the act of consummating a purchase of goods or services in accordance with the terms and conditions of a Program Campaign with the use of a Payment Card to which it is Linked.

“Redemption Value” shall mean the value of the discount, rebate or other benefit of a validated Redemption.

“Services” means any products, services, content, features, technologies, or functions, and all related websites, applications and services offered to you by the Company for participation in the Program.

“Sites” means the websites, mobile apps, official social media platforms, or other online properties through which we offer the Services. Our website address is plink.ai.

“Third-Party Providers” shall mean third party service providers (including Collinson), publishers, resellers, contractors, agents, and Financial Institutions used by the Company and/or Collinson during the course of this Agreement.

“Transaction Data” shall mean all data relating to Campaigns, including Linking, Redemption, Transaction Matching data related thereto, collected by Third Party Providers.

“Transaction Matching” shall mean the validation of qualifying Participant transactions executed with Merchants using a Payment Card and transmitting relevant Transaction Data to the Company to complete the process for crediting Savings and other benefits to Participant Accounts.

“User” means an individual or Merchant who uses the Services or accesses the Sites and has established a relationship with the Company by enrolling and agreeing to the program Terms of Use.

Personal Savings Program

The Company operates a technology enabled Personal Savings Program and owns and operates the www.plink.ai website. We invite Participants to visit our website and register for the Program to begin earning a variety of Personal Savings offered to Participants through our Program in exchange for patronage with our Merchants. When using the Program, you agree that you are subject to any additional posted guidelines, rules, terms and conditions applicable to such use of the Program, which are hereby incorporated by reference into this Agreement.

The Company enters into agreements with Merchants which agree to participate in our Program and we provide various Campaigns and Personal Savings on the Merchant’s behalf as an incentive to make purchases. Participants register their eligible credit and debit cards through our platform and agree to transaction monitoring via our Third-Party Partners including Collinson. When Participants use their registered Payment Card to make transactions at participating Merchants or through our platform, we use Transaction Data to provide Savings and redeem offers. We receive the Participants’ Qualified Transactions from a data processor who has security qualifications meeting exacting standards of the Payment Card Industry (“PCI Compliant”).

Personal Information Collected by the Company

We will collect information from you when you register with us, visit our Site and make purchases at participating Merchants. This information may include:

  1. Enrollment Information
    When you enroll in our card rewards program or provide updates to your profile, we will collect information including your name, address, email address and any other contact information.
  2. Transaction Data
    By registering a Payment Card (e.g., eligible debit card or credit card), you authorize the Company to share your Payment Card information with the applicable payment network(s) (such as MasterCard, VISA, and American Express) so they know you enrolled, in addition to Collinson CLO, Inc., which acts as our service provider in making available offers linked to your Payment Card. You authorize the applicable payment network(s) and Collinson CLO, Inc. to monitor transactions on your registered card(s) to identify qualifying purchases in order to determine whether you have qualified for or earned an offer linked to your Payment Card, and for the payment networks, including MasterCard, VISA and American Express, to share such transaction details with Collinson CLO, Inc. and the Company to enable the Program. You may opt-out of transaction monitoring on specific card(s) you have registered by logging into your account at www.plink.ai, selecting "Manage My Cards" from the menu, and removing your desired card.

    If you are a resident of the State of California, under California Civil Code sections 1798.83-1798.84, you have the right to request notice identifying the categories of personal information that the Company shares with our affiliates and/or third parties for direct marketing purposes. Since we do not share personal information with affiliates or third parties for direct marketing purposes, we are exempt from this requirement.

How we use your Personal Information

The Company will use your Personal Information to administer the Program, including, without limitation, sending you emails regarding your account.

Notwithstanding anything to the contrary in these Terms of Service or the Privacy Policy, the Company and its Third-Party Service Providers (including Collinson CLO) will use Transaction Data solely as follows:

We will not sell or otherwise deliberately provide your Personal Information to anyone unrelated to the Company for soliciting you for products or services unrelated to the Program, except as allowed by you through opt-in requests made on our Website. We may also disclose some or all your Personal Information as required by court order or other legal demand or as required by federal, state, or local laws, rules, and regulations.

Administering the Program

In administering the Program, we will share your Personal Information with selected third parties for the sole purpose of transaction tracking to properly and securely measure your purchases to determine proper reward achievement. Such third-party tracking will include all transactions made at participating Merchants, the results of which may be shared with these Merchants. Your earned rewards can be found by logging into your account at www.plink.ai. We may also use aggregated reward statistics to help Merchants improve their offers to our Participants.

Collinson CLO, Inc. Collinson CLO, Inc. is a third-party service provider utilized by the Company to link available offers to your Payment Card(s). Collinson CLO, Inc. monitors transactions on your registered Payment Card(s) to identify qualifying purchases to determine whether you have qualified for, or earned, Personal Savings linked to your Payment Card. In the event you want us to cease using your information and thereby cancelling use of our Services, please contact us at info@plink.ai. We will retain your Personal Information in accordance with our Data Retention disclosure provided in this Policy.

Privacy Policy Changes

Data Retention

We securely retain Personal Information for business administration purposes and to fulfill legal or regulatory obligations as may be required. It may be necessary to retain Personal Information for longer periods than required by law, provided it is not prohibited by law and is in the best interests of our business. We will continue to protect, use and disclose such Personal Information as described in our Privacy Policy and amendments from time to time.

Protection of Children’s Privacy.

Children’s privacy is a high priority in all industries. Because our Services are not directed to or intended for use by children under the age of 18, we do not collect personal information from children under 18 on the Site, either intentionally or knowingly.
